NOTICE TO BIDDERS
Texas Boat Auction reserves the right to cancel all bids and end an auction early should the vessel no longer be available for sale. This vessel is offered subject to prior sale, price change, or withdrawal without notice.
Bidding - Your bid constitutes a legally binding contract. Please do not bid if you're not seriously interested or financially able to purchase this vessel. All non-paying high bidders will be reported to eBay, and negative feedback will be posted. When you place a bid, you are bidding to buy. If you have any questions, ask them BEFORE you place a bid. Customers with zero or negative feedback on eBay Motors MUST CALL BEFORE BIDDING on any vessel to verify your ability and integrity to fulfill your obligation on the purchase of the item offered. If you have zero or negative feedback and bid before contacting our Business Manager, Billy Mitchell, at 512.219.2718, your bid may be canceled and you will be blocked from further bidding.
Bid Retractions - Bid retractions are not allowed nor will be recognized within 12 hours of auction closing. Seller will not be obligated to sell in the event of a late retraction. In the event of a bid retraction within the last 24 hours of auction Texas Boat Auction reserves the right to cancel the auction and relist the vessel to maintain the integrity of the auction process.
Successful Bidder - The winning bidder will be contacted via email after the auction closes and he/she must contact Texas Boat Auction within 24 hours to proceed with payment and delivery arrangements.
TERMS AND CONDITIONS
Deposit - The successful high bidder will submit a $2,000 refundable deposit within 24 hours of the close of the auction to secure the vessel. We accept Pay Pal or credit card for the deposit.
Inspection and Contingencies - Texas Boat Auction offers the details of this vessel in good faith but cannot guarantee or warrant the accuracy of this information nor warrant the condition of the vessel. This vessel is being sold as is. Buyer should personally investigate, or instruct his or her agent, or surveyor, to investigate such details as the Buyer desires validated within 14 days of the close of the auction. Texas Boat Auction has tried to disclose all information known about this vessel. Please be advised that pre-owned vessels will have typical scratches and wear inherent for their age and can be subject to future structural and mechanical failure.
Refundable Deposit - The deposit is refundable within 14 days of the close of the auction with the following contingencies: 1) Buyer acceptance of the visual and mechanical inspection conducted by Buyer or by an agent or surveyor of Buyer at Buyer expense and 2) Buyer acceptance of performance of vessel during a Sea Trial conducted by Buyer or by an agent or surveyor of Buyer. We can assist the Buyer in locating and contacting a reputable local surveyor. No refund will be processed if Buyer or agent or surveyor of Buyer does not complete the visual and mechanical inspection or sea trial. No deposit refund will be processed after 14 days of the close of the auction unless the schedule of a local and recognized surveyor delays this timeline providing the inspection was scheduled within 48 hours of the close of the auction.
Payment of Balance Due - Buyer agrees to pay remaining balance due (plus applicable fees and taxes) within 14 days of the close of the auction. All financial transactions must be completed before release and/or delivery of the vessel. The following payment methods accepted for the balance due, less the deposit, are: bank wire transfer, cash (in person) or bank financing secured though Texas Boat Auction. All funds must be in US dollars only. Please be sure to have full payment and/or approved financing in place before making your final bid. After the sale is final we will hold the vessel and title until we have verified all funds are in our possession. Once final payment is made, any insurance coverage becomes the responsibility of the Buyer.
Additional Fees and Taxes - All Buyers are subject to applicable state and local taxes and doc fees. Buyers who reside in the state of Texas will be charged all state, county, city taxes and fees, as well as title/registration fees. Out-of-state Buyers are responsible for all state, county, city taxes and fees, as well as title/registration fees in the state that the vessel will be registered.
Shipping - Buyer is responsible for all shipping arrangements and charges. Save time and money with uShip and access transportation companies who will bid on moving this vessel to your location. We assume no responsibility for damages incurred after leaving our premises. Full payment must be received before the vessel is released to any shipping company. All loading and hauling fees and charges incurred in transporting the vessel are the responsibility of the Buyer.
Warranty - No representations or warranties are made by seller, nor are any representations or warranties relied upon by bidders in making bids. Original manufacturer's warranties may still apply. If applicable, all warranty transfer paperwork and fees are the responsibility of the Buyer.
Storage - Texas Boat Auction can arrange for storage of the vessel until it is transported. Storage will be at the Buyer expense after the sale is final. A daily storage rate will be determined based on the size and location of the vessel and duration of storage.
